Terms of Service

Welcome to TaraGarden. These Terms of Service ("Terms") govern your use of the TaraGarden application and website at taragarden.ai (the "Service"), operated by The InGen Corporation / InGen Publishing ("InGen," "we," "us"). By creating an account or using the Service, you agree to these Terms.

1. What TaraGarden Is

TaraGarden is an AI-powered garden management service. It helps you identify and catalog plants, organize your garden into zones, receive care and watering guidance, and — for users with a compatible connected irrigation system — schedule and run watering. The AI assistant ("Tara") provides information and convenience features to help you care for your garden.

2. Accounts

You must provide accurate information when you create an account and keep your login credentials secure. You are responsible for all activity under your account. You must be at least 18 years old, or the age of majority in your jurisdiction, to subscribe.

3. Subscription, Free Trial & Billing

Plain-language summary: TaraGarden is $59 per year. Your first 7 days are free. We collect your payment method up front, but you are not charged until the trial ends (day 8). You can cancel anytime — including during the trial — and keep access through the period you've paid for. No weekly charges, no surprise fees.

Price. The subscription is US $59.00 per year unless otherwise stated at the time of purchase.
Free trial. New subscriptions include a 7-day free trial. A valid payment method is required to start the trial. You will not be charged during the trial.
First charge & renewal. If you do not cancel before the trial ends, your payment method is charged $59 at the end of the 7-day trial, and then automatically once per year on each renewal date, until you cancel.
Cancellation. You may cancel at any time through the "Manage Subscription" option in the app or by contacting billing@theingencorporation.com. When you cancel, you retain access through the end of your current paid (or trial) period, and you are not billed again.
Payment processing. Payments are processed by Stripe. We do not store your full card details; Stripe handles them under its own terms and security standards.

4. Refund Policy

Because we offer a 7-day free trial during which you are not charged and may cancel at any time, payments are non-refundable after the trial ends. We do not provide prorated or partial refunds for unused time after a charge. If you don't wish to be billed, simply cancel before your trial ends. This refund policy does not limit any rights you may have under applicable law that cannot be waived.

5. Tara & AI-Generated Guidance — Important Disclaimer

Tara provides plant identification, care suggestions, watering recommendations, and conversational assistance using artificial intelligence. This information is provided for general informational and convenience purposes only. It may be incomplete or inaccurate, and it is not professional horticultural, agricultural, veterinary, or safety advice.

Plant identifications and toxicity information may be wrong. Do not rely on the Service to determine whether a plant is safe to eat or safe for children or pets. When in doubt, consult a qualified expert.
Care and watering recommendations are estimates. You remain responsible for your own plants, property, water usage, and gardening decisions.

6. Connected Irrigation Control

If you connect a compatible smart irrigation system, the Service can schedule and run watering on your behalf, including automated rain-aware adjustments. You acknowledge that:

You are responsible for correctly configuring your irrigation hardware and for the consequences of watering (or not watering), including water usage and costs.
Automated features depend on third-party hardware, weather data, and network connectivity, which may fail or be inaccurate. The Service may not water when expected, or may water when you did not expect.
We are not liable for water damage, over- or under-watering, plant loss, equipment issues, utility costs, or any other outcome arising from irrigation features. You should maintain independent controls and monitoring for your irrigation system.

7. Acceptable Use

You agree not to misuse the Service, including: attempting to disrupt or reverse-engineer it; using it to violate any law; uploading unlawful, harmful, or infringing content; or attempting to access other users' data. We may suspend or terminate accounts that violate these Terms.

8. Your Content

You retain ownership of the photos, plant data, and other content you add ("Your Content"). You grant us a limited license to store, process, and display Your Content solely to operate and improve the Service for you, including sending relevant content to our AI provider to generate Tara's responses. 9. Service Availability

We work to keep the Service available but do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue features at any time. The Service is provided "as is" and "as available" without warranties of any kind, to the fullest extent permitted by law.

10. Limitation of Liability

To the fullest extent permitted by law, InGen and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for plant loss, property or water damage, lost profits, or lost data, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the 12 months before the claim.

11. Termination

You may stop using the Service and cancel at any time. We may suspend or terminate your access if you violate these Terms or if required by law. Provisions that by their nature should survive termination (such as disclaimers, limitations of liability, and refund terms) will survive.

12. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date and, where appropriate, notify you. Continued use of the Service after changes take effect constitutes acceptance.

13. Governing Law

These Terms are governed by the laws of the State of Tennessee, USA, without regard to its conflict-of-laws rules. Any disputes will be subject to the courts located in Tennessee, unless otherwise required by applicable law.
